ok. so before this gets stupid fast lemme say i do understand max engage. what i dont understand is if hes max engaged and i cannot hit him, why is his timer still able to land when hes engage is already maxed by the time his timer finishes.

Because... that's just how stab/charge work? Provided you don't get hit rolling the timer, it doesn't matter if you are max engaged by the time it finishes. This is why it's always a good idea to walk out if you can't engage.
